Vigeo – Terms of Use

Please carefully read these terms and conditions (“Terms of Use”) for use of the Vigeo Website and Vigeo App, including any communications to and from us (collectively, “Vigeo”).

1. Terms of Use

(a) By using or subscribing to the Vigeo Website, or installing the Vigeo App on your mobile device, you accept these Terms of Use and you agree to abide by them as a legally binding agreement between you and us. Your use of Vigeo or any service or content provided through Vigeo shall be deemed to constitute your acceptance of these Terms of Use, which, if you do not agree with these Terms of Use, you must cease using Vigeo immediately [and remove the Vigeo App from your device].

(b) The Vigeo Website and Vigeo App is owned and operated by Metro South Hospital and Health Service (“MSH”). MSH reserves the right to amend, modify, add, delete and make corrections to the Terms of Use and update the Vigeo Website and/or Vigeo App to incorporate new Terms of Use, at any time without notice. All changes are effective from the date they are posted and your continued use of Vigeo will constitute your acceptance of the variation of the Terms of Use. It is your responsibility to ensure you are aware of any changes to these Terms of Use.

(c) In these Terms of Use:

the expression ‘user’, ‘you’ and ‘your(s)’ refers to the person or organisation accessing and using Vigeo;

the expression ‘we’, ‘us’ and ‘our’ means MSH; and

the expression “the Vigeo Website” means the Vigeo website, located at www.vigeo.health.qld.gov.au.

The expression “the Vigeo App” means the application for mobile devices, available for iPhone and Android mobile devices.  

Intended Users

Vigeo is intended for doctors, nurses and allied health professionals practising within Queensland.  It is not intended for persons under the age of 18 years. 

No other person is permitted or authorised by MSH to access or use Vigeo.

INFORMATION DISCLAIMER

THE INFORMATION INCLUDING ANY ADVICE AND RECOMMENDATIONS AVAILABLE THROUGH VIGEO IS INTENDED SOLELY AS GENERAL EDUCATIONAL OR FOR INFORMATION PURPOSES ONLY.  IT IS NOT INTENDED AS MEDICAL OR HEATH CARE ADVICE, OR TO BE USED FOR MEDICAL DIAGNOSIS OR TREATMENT, FOR ANY INDIVIDUAL PROBLEM.  IT IS ALSO NOT INTENDED AS A DIAGNOSTIC TOOL FOR YOUR PATIENTS.

WE ASSUME NO RESPONSIBILITY FOR ANY CONSEQUENCE RELATING DIRECTLY OR INDIRECTLY TO ANY ACTION OR INACTION YOU TAKE BASED ON THE INFORMATION, SERVICES, OR OTHER MATERIAL ON VIGEO. WE DO NOT GIVE ANY ASSURANCES, AND WILL NOT BE RESPONSIBLE FOR, ANY DAMAGE OR LOSS RELATED TO THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE INFORMATION ON VIGEO.

2. Use of Vigeo and data

2.1 Use

(a) You may access Vigeo, to view, use and display Vigeo for your personal use only.  You may not use Vigeo for any other purpose.

(b) You acknowledge that you have no rights in, or to, Vigeo or technology used or supported by Vigeo, other than the right to use Vigeo in accordance with these Terms of Use.

(c) You are responsible for all access to the Vigeo App through your mobile device.

2.2 Limitations of Use

You must:
(a) use Vigeo in accordance with these Terms of Use;

(b) not copy, transmit, distribute, reproduce, licence, alter, reverse engineer, adapt or modify the whole or any part of Vigeo in any way whatsoever;

(c) not use Vigeo in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement, or hacking into or inserting malicious code, destruction of data, including viruses, or harmful data, into Vigeo; or

(d) not use Vigeo in any way that could damage, disable, overburden, impair or compromise Vigeo; and(e)comply with any applicable law and regulation relating to downloading content or applications used or supported by Vigeo.

2.3 Availability and Functionality

(a) You acknowledge that no data transmission over the internet can be guaranteed as totally secure. We do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information that you transmit to Vigeo is transmitted at your own risk. If you become aware of any problems with security of the data or Vigeo, please contact us at Metro_South_Web_Team@health.qld.gov.au

(b) Due to the nature of the Internet, we make no warranty, representation or guarantee that your access to Vigeo will be uninterrupted, timely or error-free.  We are not liable if, for any reason, Vigeo is unavailable for any time or for any period.  We may occasionally need to carry out repairs, maintenance or introduce new facilities and functions, which may result in Vigeo being unavailable.

(c) We may change or update the Vigeo App at any time and without notice to you.  To continue using the Vigeo App, you may need to download and install the new version.  By doing so you agree to be bound by these Terms of Use, as they exist at that time.

2.4 Termination

We reserve the right to suspend or cease operating Vigeo at any time, without notice, and to terminate this Agreement. At any time you may terminate this Agreement by ceasing your subscription (if applicable) and ceasing all use of Vigeo.

2.5 Intellectual Property

All intellectual property rights relating to the Vigeo Website and Vigeo App are owned by MSH or our related entities and licensors.  You acquire no rights or licences in or to the Vigeo Website and Vigeo App other than the limited right to use the Vigeo Website and Vigeo App in accordance with these Terms of Use.  We reserve all rights not expressly granted under these Terms of Use.

All intellectual property rights in any information and material published on Vigeo is owned by, or licensed to, MSH and all intellectual property in any information and material published on any linked website is owned by or licensed by others.

Subject to your compliance with these Terms of Use, we grant to you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install and use the Vigeo App on your mobile device, solely for use by you in accordance with these Terms of Use.

You must not do anything with the Vigeo Website and Vigeo App that is not expressly authorised by these Terms of Use.  Without limitation, you must not copy, distribute, modify, adapt, reverse engineer, decompile or disassemble the Vigeo App, or merge the Vigeo App with any other software.  You must not remove any copyright notices or other copyright protection measures from the Vigeo Website or Vigeo App.

2.6 Privacy

By submitting your personal information through Vigeo and/or using Vigeo, you consent to our collection, use, disclosure and storage of that personal information in accordance with our Privacy Statement and the Information Privacy Act 2009 (Qld).  You can access our Privacy Statement at https://metrosouth.health.qld.gov.au/privacy.

2.7 Independence from Platforms

(a) Vigeo is independent of any platform on which it is located.  The Vigeo App is not associated, affiliated, sponsored, endorsed or in any way linked to any platform operator, including, without limitation, Apple, Google, Android or RIM Blackberry (each being an Operator).

You and we acknowledge that these Terms of Use are concluded between us only, and not between you and an Operator or any of its subsidiaries.  We, and not the Operators, are solely responsible for the Vigeo App and its content to the extent specified in these Terms of Use.

You acknowledge and agree that the relevant Operator, and that Operator’s subsidiaries, are third party beneficiaries of these Terms of Use and may have third party rights to enforce these Terms of Use against you.

3. Exclusion or warranties, liability

3.1 Exclusions of warranties

Nothing in these Terms of Use restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 

Vigeo, and all content and (any) services on or available through Vigeo, are provided on an ‘as is’ and ‘as available’ basis and without warranties of any kind, expressed or implied except any which may be implied by statute and are incapable of exclusion, in respect of Vigeo or its content.  The content and (any) services on or available through Vigeo are provided as general information only and do not constitute medical or health advice of any kind.

Except as specifically provided herein, to the maximum extent permitted by law, MSH expressly excludes and disclaims, and does not make any representation, warranty or endorsement of any kind, whether express or implied, in relation to the content, accuracy, completeness, accessibility, suitability, safety, security, reliability, currency or any other aspect of:
(a) any material and/or information made available on or through Vigeo ;
(b) the performance and availability of Vigeo or any linked website or mobile application; or
(c) the loss, damage, corruption or degradation of any data or other material as a result of the use of Vigeo or any linked website or mobile application.

3.2 Exclusion of liability

Australian consumer law implies certain consumer protection terms into these Terms of Use. In respect of any such implied conditions, warranties or guarantees which MSH cannot at law exclude, to the extent permitted by law, the liability of MSH is limited, at our option, to the replacement, repair or resupply of Vigeo App, or a refund of the purchase price (if any) of the Vigeo App to you.

To the maximum extent permitted by law and without limiting your rights under the Competition and Consumer Act 2010 (Cth), MSH excludes all liability for any loss or damage whatsoever which is suffered by you, whether arising under contract, tort (including negligence), equity, statute or any other cause of action, or otherwise, (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages, loss of income, loss or profits, loss, damage or corruption of data) arising from, as a result of or incidental to:
(a) the use of, reliance on, or action taken as a result of, any information or material in the Website or any linked website for any decision or otherwise;
(b) accessing, displaying and using the Website or any linked website and/or participating in any on-line activities contained therein;
(c) any interruption, suspension or termination of the Website or any linked website in whole or in part for whatever reason including failure of or suspension of public or private telecommunications network;
(e) the unavailability, unsuitability, non-currency and non-connectivity of third party sites or applications, or content or services on such websites or applications;
(f) any loss, damage, corruption or degradation of any data or other material as a result of the use of the Website or any linked website and or viruses or other technologically harmful material that may infect your computer or mobile device due to your use of the Website or any linked website.

The exclusion of liability and limitations in these Terms of Use will apply to claims whether in contract, tort (including, without limitation, negligence) or equity and even if MSH, the State of Queensland or Queensland Government has been notified of the possibility of such loss or damage.

You must comply with all laws applicable to your use of Vigeo and the applicable Operator terms and conditions of use.

3.3 Your risk

You access the Vigeo and any linked website at your own risk and MSH accepts no responsibility for any interference, loss, damage or disruption to your own computer or mobile device or otherwise which arises in connection with your use of Vigeo or any linked website or application. You must take your own precautions to ensure that the process which you employ to obtain access to Vigeo or any linked website or application does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your computer or mobile device or otherwise cause you or any person loss, damage or corruption.

3.4 Downloadable material

We make downloadable documents, software and other materials available under the following conditions:
(a) Downloadable material within Vigeo and any linked website is provided on the basis that you will conduct any necessary virus scanning and other checks so as to protect your data, mobile or computer device and software systems and those of any other person.
(b) You agree that we will not be liable to you for any loss, injury or damage however caused (including by negligence) that arises in any way from the use of the downloaded material.
(c) If you provide the downloaded material to another party you must bring the other party’s attention to these conditions.

4. Third party websites and applications

Vigeo contains links to websites and mobile applications and any feeds from third party website and social media profiles owned and operated by third parties, who are not under the control of MSH, the State of Queensland and/or Queensland Government.  MSH cannot be responsible for the content or accuracy of the information or other material on these websites or mobile applications.  The provision of a link to an external website or mobile application does not constitute an endorsement or approval of that website or mobile application, or any of the products or services.  We are not liable for any damages or injury arising from your access to such sites, applications or content. If you choose to click on a link within Vigeo and go to other unaffiliated websites or applications, including those of social networks or advertisers, we are not responsible for the privacy practices of those sites.

5 General

These Terms of Use are governed by the laws of Queensland.  You and MSH submit to the non-exclusive jurisdiction of the courts of Queensland and courts with jurisdiction to hear appeals.

If any part of these Terms of Use is invalid, unenforceable or illegal in a particular jurisdiction, such part will be struck out and the remaining terms will remain in full force.

You represent and warrant that you are not located in a country that is subject to a U.S Government embargo, or that has been designated by the U.S Government as a “terrorist supporting” country and you are not listed on any U.S Government list of prohibited or restricted parties.
